Introducing Tedavi, a brand new 2022 Fountaine Pajot Aura 51. Her sleek design seamlessly combines fantastic sailing capabilities with luxurious and comfortable spaces for living and relaxing. A great new feature is the complete opening between the saloon and the cockpit, an innovation which will offer you an even greater feeling of freedom and space. The galley and saloon are modern and bright adding to the spacious feel of this newly designed 51 foot catamaran. The large table in the cockpit seats eight adults comfortably for al fresco dining, playing some board games or enjoying a movie on the 60-inch projector screen. She has a large flybridge offering 360 degree views with plenty of lounge seating and a sunbathing area for all to enjoy. The foredeck is another spacious area with reclinable seating and areas for relaxation. Both areas can be covered with sun shades, allowing you to enjoy the ocean breeze while taking in the beauty of your natural surroundings in comfort. Tedavi has four queen cabins, one of which is a spacious master cabin with an additional entrance opening onto the aft deck for direct bed to ocean access. All cabins have en-suite bathrooms with electric freshwater toilets, individually controlled air conditioning units, multiple integrated USB ports and queen beds which face the ocean for the perfect view to wake up to. Tedavi means “healing” in Turkish and is the perfect name for this beautiful yacht on which you can experience the healing power of sailing on a vacation unlike any other.

MEET YOUR CREW CAPTAIN: JAMES ELLWOOD CHEF: ELLIE ARCHER James, hails from England and has always had a love for the water. This love took its first official steps when he achieved his PADI Junior Open Water Scuba Diver at age 10, progressing on to the professional PADI Divemaster he is today. In 2015, James took up sailing at the Hartlepool Yacht Club, spending a great deal of time cruising the North Sea aboard the Black Diamond of Durham and partaking in numerous Tall Ship regattas. In 2018 James became a RYA Yachtmaster and began his career as a professional captain. Running vacations in the Mediterranean, James has taken guests on charter in Spain, Croatia, Greece, Turkey, Italy and Montenegro. James has also undertaken many ocean deliveries, enjoying the tranquility of spending continuous weeks at sea. More recently James has enjoyed the sailing and diving lifestyle that the Caribbean has to offer. He is committed to delivering that “awe and wonder” experience to all those that come aboard making sure they have a truly unforgettable vacation! Having grown up in Australia, Ellie has always lived a life of adventure in the outdoors. She fondly recalls the many weekends of hikes and camping her friends and family would go on, and the adjoining activities such as kayaking and rock climbing that would occur. Since childhood, Ellie always had a passion for showing love through food. Whether that meant bringing people together through a shared bite, or perhaps dropping off a sweet treat to brighten someone’s day, she knew how much a meal could mean to people. After a few years of travelling the world, Ellie, or known affectionately as “Archie” by her cheffing peers, decided to pursue her commercial cookery and patisserie qualifications. This led her to work for some of the most renowned restaurant groups and cafés in Melbourne, where her skills were able to exponentially skyrocket. After having worked on yachts in both Europe and the Caribbean previously, Ellie knew it was her calling to come back to where she was able to combine her two loves of cooking and outdoor adventure. She loves welcoming guests on board and providing the best curated experience, not only cooking for guests but also taking them on water and onshore adventures. On charter, Ellie loves nothing more than to see clients genuinely enjoying themselves under her care, and understands that it´s the small details that really make a trip memorable. You’ll wake with a sense of excitement, and end the day with a full belly and a mind full of memories. With her and James’ enthusiasm and knowledge, they know that after a week with them their guests will leave having just experienced one of the best weeks of their lives.

Such Ease and Grace

How is it possible that each day is better than the previous? Each meal better than the last? Every moment perfect and memorable? Because Ellie and James make it that way. Doing so with such ease and grace, I´m sure that living aboard with people you don´t know for a week has to be overwhelming and challenging, but these guys have the love, joy and passion for hospitality. Thanks you for the best rip ever. Period. First off, the food YUMMMMM!! I´m sorry I didn´t beat my pancake eating record again. Thank you for going out of your way to make this week as magical as it could be. The snorkeling was AMAZING. As my first time ever going to the BVI´s it sure was the best it could ever be. the sailing was so much fun because we could just relax and like an hour later we were in the most calm and beautiful places. Also, the sea scooters were the most fun things I have done. I could not stop playing. Your new boat is amazing, the layout is different but we love it. thank you too for going out of you way to make the scuba dives happen and getting all of us set up.

All the planning and hours, days, weeks and months of your sweat that goes into making one week for us perfect will never go unnoticed by our family. Being with the two of you is icing on the cake! The food, the experience and the ability for our family to enjoy one another is priceless. We didn´t quite know what to expect and both of you exceeded our wildest dreams about a boat trip vacation! From the amazing breakfasts to desserts.. the meals were outstanding. You really need to assemble a ´Rebecca Cook Book. The daytime adventures with Heiko were always memorable. He was always so patient and anticipated everything we all needed. Unbelievable!

Heiko and Rebecca were unbelievable! From the first moment we stepped on board we felt 100% comfortable and relaxed. The accommodations were perfect and immaculate (The entire trip!) The food and drinks were exactly what you would want to eat on a tropical vacation. Heiko and Rebecca knew exactly what we wanted before we knew what we wanted. Heiko made us so comfortable in the ocean and gave us a five star snorkeling experience (MULTIPLE TIMES) Rebecca´s food was INSANELY delicious and was perfectly complimented with heinous cocktails/desserts. The Best Vacation We have Ever Gone On!

As the father and planner of our family vacations, it is always difficult to plan a trip that all four kids will love. We have been all over North America together and my wife and kids all say that THIS was the best vacation we have gone on. On this trip we got to experience the Virgin Islands. This is experience was because of Heiko and Rebecca. My kids think that Heiko is a super hero. He took us to places in the ocean that were truly amazing. He taught us how to hold our breath for 1.5 minutes and free dive to 25 feet. He even found our lost phone at the bottom of the ocean. He is a real life Aquaman! In all of our vacations we have never had such awesome eating experience and that was because of Rebecca! Every meal, every snack, every dessert were truly delicious. The whole family is asking if we can do this trip again but only if we can do it with Rebecca and Heiko! They really made this trip truly special. We all now consider them friends and we WILL see them again.

Five Stars!

To say Rebecca and Heiko exceeded expectations is an understatement. A nice boat is nice boat but the crew makes it special. These two are fantastic! They made our family vacation so special from the 50th anniversary banner, cups and welcome champagne to the wonderful meals and snorkel trips. We would do this trip with this crew all over again!

The Best Crew To Have On A Boat!

Heiko and Rebecca are the best crew to have on a boat. Heiko was basically Aquaman and found all the sea creatures for us to see! Rebecca was the most amazing chef, I looked forward to every meal the entire trip! The entire trip was amazing from start to finish!

This has been hands down our best family vacation! From day 1 to day 7 there was so much to see and so much fun had by all. It was amazing to have such a great duo Heiko and Rebecca! Rebecca had the most amazing meals planned for breakfast, lunch, dinner and appetizers. to make all the member of our family happy with food, is one GREAT accomplishment! Heiko thank you for all your help (and patience) with our crew. All the pointers on breathing techniques given were so helpful. You were the BEST dive master. All the things we got to see and learn about during our scuba and snorkel dive are unforgettable. With a family of 6 it is rare that we all agree but without a question this will forever be our FAMILY´S BEST VACATION EVER (until next year and we see you guys again. Thank you from the bottom of my heart for making this such a memorable bonding family vacation for us.

Crew Profiles: MEET YOUR CREW:

Heiko, born and raised in Germany, is an RYA Yachtmaster Offshore. He left his job in IT management in 2014 to begin his dream to travel. Initially intending to be away for about a year, he soon realized that going back to an office-based job did not feel right for him anymore. Since then he has travelled throughout South and Central America, Europe, Southeast Asia, Africa and Australia. During this time he visited 30+ countries, speed-hiked the Camino de Santiago, hiked up 5000m high mountains, learned to speak Spanish, went scuba and freediving around the world and had many more beautiful experiences above and below the water. He is a Freediving Instructor and PADI Divemaster. Heiko loves to be out in the blue of the ocean and enjoys sharing his passions as a guide by creating safe and unique experiences.

Rebecca was born and raised in New York City but has lived all around the world since 2004. After graduating from NYU in 2002 with B.A. in Economics & Psychology, Rebecca worked in the financial services industry in New York and Hong Kong. A trip to Australia in 2005 changed her life – she learned to scuba dive on the Great Barrier Reef and fell completely in love with scuba diving . Two years later, she left the concrete jungle and trading floor for real jungles and sea floors.

She spent two months diving her way around the Philippines, three months on a marine conservation expedition in Madagascar and four months completing her Divemaster internship in Malaysia. Afterwards, life took an unexpected turn and she found herself living in Sweden for a year, where she discovered her love for sailing and life afloat. Still holding onto her dream to teach scuba and share the underwater world with others, she put her plans for sailing to the Caribbean on hold to become a PADI Instructor in 2009. She has worked in Thailand, Hawaii and Indonesia for a over decade in nearly every facet of the scuba diving industry, from guiding and instructing to dive center and resort management to working on a liveaboard. She loves life in the tropics, surrounded by water, nature and wildlife and thrives on sharing her passions with her guests.

Heiko and Rebecca obtained their RYA Yachtmaster Offshore qualifications together in Gibraltar in 2020, sailing thousands of miles along the coasts of Spain, Portugal and Morocco, dodging the infamous orcas along the way.

They are passionate about providing a highly professional level of service in a relaxed and friendly atmosphere while creating the most memorable experiences for their guests. They love getting to know you and tailoring each charter to your preferences and desires, allowing you to kick back, relax and enjoy. With a deep love and respect for the natural world, they maintain a strong focus on environmentally aware hospitality and best practices to ensure minimal impact on the environment.

The food is a big part of your experience on board and you can expect to be well taken care of by this food-loving duo. Rebecca will take you on a culinary tour around the world, creating fresh, flavorful dishes inspired by her multi-cultural background as well as her many years of travel and living in different countries, while Heiko’s swoon-worthy desserts will surely satisfy your sweet tooth. They are happy to cater to a variety of dietary requirements and in particular, specialize in vegetarian and vegan cuisine.

Heiko and Rebecca are back for their third charter season in the Virgin Islands after two very successful seasons running a total of 40 charters. It has a large flybridge, with its friendly lounge and sunbathing area for all to enjoy. Tedavi has 4 cabins, one of which is a master cabin and 3 queens cabins, all with bathrooms ensuite. The galley and salon are modern and clean-lined adding to the spacious feel of this newly designed catamaran.

Represented by DMA Yachting, the majestic charter yacht TEDAVI is a 51 ft power catamaran. The highlights of TEDAVI are her absolute comfort and culinary experience. TEDAVI spends the summer and winter season in US Virgin Islands. She was constructed by the ship builder Fontaine Pajot in 2022. The ingenious yacht layout features 4 large cabins and comfortably accommodates up to 8 guests.

TEDAVI is offered primarily as a power catamaran. The the core layout is spread out from the main saloon, which connects to the aft deck. The aft deck features a variety of seating areas and that's where the guests spend most of their time. The fascinating cabins offer unbeatable views in the morning and are located just below deck. The cabins offer designer mattrace beds and feature ensuite bathrooms. Multiple portholes connect you with the outside world.

Introducing Tedavi, a brand new 2022 Fountaine Pajot Aura 51. Her sleek design seamlessly combines fantastic sailing capabilities with luxurious and comfortable spaces for living and relaxing.

The large table in the cockpit seats eight adults comfortably for al fresco dining, playing some board games or enjoying a movie on the 60-inch projector screen. She has a large flybridge offering 360 degree views with plenty of lounge seating and a sunbathing area for all to enjoy. The foredeck is another spacious area with reclinable seating and areas for relaxation. Both areas can be covered with sun shades, allowing you to enjoy the ocean breeze while taking in the beauty of your natural surroundings in comfort. Tedavi has four queen cabins, one of which is a spacious master cabin with an additional entrance opening onto the aft deck for direct bed to ocean access. All cabins have en-suite bathrooms with electric freshwater toilets, individually controlled air conditioning units, multiple integrated USB ports and queen beds which face the ocean for the perfect view to wake up to.

CAPTAIN: JAMES ELLWOOD

James, hails from England and has always had a love for the water.

This love took its first official steps when he achieved his PADI Junior Open Water Scuba Diver at age 10, progressing on to the professional PADI Divemaster he is today.

In 2015, James took up sailing at the Hartlepool Yacht Club, spending a great deal of time cruising the North Sea aboard the Black Diamond of Durham and partaking in numerous Tall Ship regattas.

In 2018 James became a RYA Yachtmaster and began his career as a professional captain.

Running vacations in the Mediterranean, James has taken guests on charter in Spain, Croatia, Greece, Turkey, Italy and Montenegro. James has also undertaken many ocean deliveries, enjoying the tranquility of spending continuous weeks at sea.

Having grown up in Australia, Ellie has always lived a life of adventure in the outdoors. She fondly recalls the many weekends of hikes and camping her friends and family would go on, and the adjoining activities such as kayaking and rock climbing that would occur.

Since childhood, Ellie always had a passion for showing love through food. Whether that meant bringing people together through a shared bite, or perhaps dropping off a sweet treat to brighten someone’s day, she knew how much a meal could mean to people. After a few years of travelling the world, Ellie, or known affectionately as Archie” by her cheffing peers, decided to pursue her commercial cookery and patisserie qualifications. This led her to work for some of the most renowned restaurant groups and cafés in Melbourne, where her skills were able to exponentially skyrocket.

After having worked on yachts in both Europe and the Caribbean previously, Ellie knew it was her calling to come back to where she was able to combine her two loves of cooking and outdoor adventure. She loves welcoming guests on board and providing the best curated experience, not only cooking for guests but also taking them on water and onshore adventures. On charter, Ellie loves nothing more than to see clients genuinely enjoying themselves under her care, and understands that it's the small details that really make a trip memorable. You’ll wake with a sense of excitement, and end the day with a full belly and a mind full of memories.

This yacht offers all inclusive pricing

Up to eight guests can be accommodated in her four cabins. She features a master cabin with walk around queen berth, along with three guest cabins, each with queen berth. All cabins offer en-suite bathroom facilities.

The main salon offers dining and lounging with large windows for plentiful lights and great views. There is a complete opening from the galley to the cockpit, for an easy flow. Out on the cockpit there is al fresco dining. Up on the flybridge you can enjoy the large conversational space and sunbathing area.

For watersports she features a tender for eight with 40hp engine, kneeboard, tube, wakeboard, two standup paddleboards, floating mat, fishing gear, and snorkeling equipment for eight.

Initially intending to be away for about a year, he soon realized that going back to an office-based job did not feel right for him anymore. Since then he has travelled throughout South and Central America, Europe, Southeast Asia, Africa and Australia. During this time he visited 30+ countries, speed-hiked the Camino de Santiago, hiked up 5000m high mountains, learned to speak Spanish, went scuba and freediving around the world and had many more beautiful experiences above and below the water. He is a Freediving Instructor and PADI Divemaster. Heiko loves to be out in the blue of the ocean and enjoys sharing his passions as a guide by creating safe and unique experiences. Rebecca was born and raised in New York City but has lived all around the world since 2004. After graduating from NYU in 2002 with B.A. in Economics & Psychology, Rebecca worked in the financial services industry in New York and Hong Kong. A trip to Australia in 2005 changed her life - she learned to scuba dive on the Great Barrier Reef and fell completely in love with scuba diving. Two years later, she left the concrete jungle and trading floor for real jungles and sea floors. She spent two months diving her way around the Philippines, three months on a marine conservation expedition in Madagascar and four months completing her Divemaster internship in Malaysia. Afterwards, life took an unexpected turn and she found herself living in Sweden for a year, where she discovered her love for sailing and life afloat. Still holding onto her dream to teach scuba and share the underwater world with others, she put her plans for sailing to the Caribbean on hold to become a PADI Instructor in 2009. She has worked in Thailand, Hawaii and Indonesia for a over decade in nearly every facet of the scuba diving industry, from guiding and instructing to dive center and resort management to working on a liveaboard. She loves life in the tropics, surrounded by water, nature and wildlife and thrives on sharing her passions with her guests. Heiko and Rebecca obtained their RYA Yachtmaster Offshore qualifications together in Gibraltar in 2020, sailing thousands of miles along the coasts of Spain, Portugal and Morocco, dodging the infamous orcas along the way. They are passionate about providing a highly professional level of service in a relaxed and friendly atmosphere while creating the most memorable experiences for their guests. They love getting to know you and tailoring each charter to your preferences and desires, allowing you to kick back, relax and enjoy. With a deep love and respect for the natural world, they maintain a strong focus on environmentally aware hospitality and best practices to ensure minimal impact on the environment. The food is a big part of your experience on board and you can expect to be well taken care of by this food-loving duo. Rebecca will take you on a culinary tour around the world, creating fresh, flavorful dishes inspired by her multi-cultural background as well as her many years of travel and living in different countries, while Heiko’s swoon-worthy desserts will surely satisfy your sweet tooth. He left his job in IT management in 2014 to begin his dream to travel. Initially intending to be away for about a year, he soon realized that going back to an office-based job did not feel right for him anymore. Since then he has travelled throughout South and Central America, Europe, Southeast Asia, Africa and Australia. During this time he visited 30+ countries, speed-hiked the Camino de Santiago, hiked up 5000m high mountains, learned to speak Spanish, went scuba and freediving around the world and had many more beautiful experiences above and below the water. He is a Freediving Instructor and PADI Divemaster. Heiko loves to be out in the blue of the ocean and enjoys sharing his passions as a guide by creating safe and unique experiences. Rebecca was born and raised in New York City but has lived all around the world since 2004. After graduating from NYU in 2002 with B.A. in Economics & Psychology, Rebecca worked in the financial services industry in New York and Hong Kong. A trip to Australia in 2005 changed her life - she learned to scuba dive on the Great Barrier Reef and fell completely in love with scuba diving. Two years later, she left the concrete jungle and trading floor for real jungles and sea floors. She spent two months diving her way around the Philippines, three months on a marine conservation expedition in Madagascar and four months completing her Divemaster internship in Malaysia. Afterwards, life took an unexpected turn and she found herself living in Sweden for a year, where she discovered her love for sailing and life afloat. Still holding onto her dream to teach scuba and share the underwater world with others, she put her plans for sailing to the Caribbean on hold to become a PADI Instructor in 2009. She has worked in Thailand, Hawaii and Indonesia for a over decade in nearly every facet of the scuba diving industry, from guiding and instructing to dive center and resort management to working on a liveaboard. She loves life in the tropics, surrounded by water, nature and wildlife and thrives on sharing her passions with her guests. Heiko and Rebecca obtained their RYA Yachtmaster Offshore qualifications together in Gibraltar in 2020, sailing thousands of miles along the coasts of Spain, Portugal and Morocco, dodging the infamous orcas along the way. The CHARTERER acknowledges the COVID-19, or any other infectious disease, entry and exit protocols for the Cruising Area as they exist on the date of execution of this Agreement and endeavors to ensure they are updated with any changes in relevant entry and exit protocols. The CHARTERER and all Guests are responsible for meeting government mandated requirements for entry or exit into the Cruising Area. In the event that the CHARTERER and Guests are not permitted entry into or exit out of the Cruising Area, or any portion thereof, because of not meeting government mandated entry or exit requirements, and not because of the Cruising Area being closed to visitors, this Agreement shall be deemed cancelled by the CHARTERER in accordance with Clause 6.A. All expenses for CHARTERER and Guests to meet government mandated requirements for entry or exit into the Cruising Area, as well as costs associated with quarantine or additional other related costs, are solely at the expense of the CHARTERER and therefore trip cancellation insurance is highly encouraged. B. In the event that the CHARTERER or any Guest becomes ill with COVID-19, or any other infectious disease, and tests positive before the start of the Charter Period, the positive test or tests will not constitute a Force Majeure event and therefore trip cancellation insurance is highly encouraged. C. In the event that any member of the Crew becomes ill with COVID-19, or any other infectious disease, and tests positive before the start of the Charter Period, the OWNER may appoint another Crew to complete the charter, failing which, CLAUSE 10. DELAY IN DELIVERY/FAILURE TO DELIVER, C. i & ii. will apply. D. In the event that any member of the Crew, the CHARTERER or any Guest becomes ill with COVID-19, or any other infectious disease, and tests positive during the Charter Period, the charter will terminate at the nearest reasonable port of disembarkation, unless otherwise agreed in writing by the captain, CHARTERER and OWNER. If quarantine is required, it cannot be done on the Yacht. Therefore, trip cancellation insurance that includes medical insurance with quarantine coverage is highly encouraged. E. Should the CHARTERER have a complaint about the Yacht or Crew, they shall notify the captain in the first instance and, if the matter cannot be resolved straight away, shall notify the OWNER through the BROKER as soon as possible, who shall attempt to remedy the matter. PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker. By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.

A great new feature is the complete opening between the saloon and the cockpit, an innovation which will offer you an even greater feeling of freedom and space. The galley and saloon are modern and bright adding to the spacious feel of this newly designed 51 foot catamaran. The large table in the cockpit seats eight adults comfortably for al fresco dining, playing some board games or enjoying a movie on the 60-inch projector screen. She has a large flybridge offering 360 degree views with plenty of lounge seating and a sunbathing area for all to enjoy. The foredeck is another spacious area with reclinable seating and areas for relaxation. Both areas can be covered with sun shades, allowing you to enjoy the ocean breeze while taking in the beauty of your natural surroundings in comfort. Tedavi has four queen cabins, one of which is a spacious master cabin with an additional entrance opening onto the aft deck for direct bed to ocean access. All cabins have en-suite bathrooms with electric freshwater toilets, individually controlled air conditioning units, multiple integrated USB ports and queen beds which face the ocean for the perfect view to wake up to.
