At our facility in Whitby, we offer year-round, heated indoor or outdoor storage. We offer the ability to store your sailboat outdoors with the mast up.  The indoor winter storage is usually sold out by late August [but we occasionally have cancellations, so call for availability].

We also offer full decommissioning services for sail and power.  Engines, water systems, AC units, generators as well as sail and canvas removal, mast de-steps, cleaning and waxing are all available at our Whitby location or offsite. Yes we are mobile!

The past three years have seen the lowest levels of used sailboat inventory offered by Yacht Brokers in Ontario. The industry is still working its way out of the trough. Slowly. Very Slowly. If you have been looking for a used sailboat in Ontario, or even throughout the Great Lakes Region, you've noticed that the selection is very limited. Used yacht inventory in Ontario has rebounded from the historic lows of spring 2022, yet is still currently under 50% of pre pandemic levels.

Sadly, more and more of our used yachts are being picked up by US Buyers. It's not a bad thing to have more competition for used boats, but when they move out of the country, it does make it more difficult to get them back. But it can be done, and we do it regularly for our Canadian boat buyers. 

We have decades of experience selling used yachts from all of the big builders including Catalina Yachts, Hunter Yachts, Tartan, Island Packet, C&C, Dufour, Beneteau, Jeanneau, CS, and many more. We are not a new yacht dealer, which we believe benefits our clients, several of our yacht brokers in Ontario have extensive experience with new yacht sales, giving you a broad knowledge base to draw on.

USED POWERBOATS FOR SALE

The last three years have seen interesting trends in the availability of used powerboats throughout Ontario. The increased demand that began three years ago resulted in a quickly reduced supply, taking used powerboat inventory in Ontario to record lows in the spring of 2021. Since then, the inventory has slowly crept back to where it sits now, within about 10% of pre pandemic levels.

Business | yacht broker responds to antitrust lawsuit: we’ve ‘done nothing wrong’.

A Fort Lauderdale-based yacht broker is seeking to dismiss a lawsuit alleging that it and numerous other members of South Florida’s yacht industry engage in unfair competition by requiring 10% commissions be paid by purchasers of preowned boats.

Denison Yacht Sales is the first of a group of yacht brokers, mostly based in South Florida, to respond to allegations leveled so far in three antitrust lawsuits filed in U.S. District Court in Fort Lauderdale.

The yacht broker lawsuits claim that trade associations, including the International Yacht Brokers Association, work in conjunction with Multiple Listing Services and individual yacht brokers to require that commissions are paid to brokers for both sellers and buyers.

The first lawsuit was filed by Wyoming company Ya Mon Expeditions on Feb. 29. That lawsuit, and two others that name Denison among more than a dozen other defendants, seek class action status.

The second lawsuit was filed on March 22 by Alabama customer Kip Lamar Snell, while a third was filed on March 26 by a company called Magna Charter LLC, identified as a yacht purchaser who paid a commission.

The lawsuits are patterned after litigation that accused the National Association of Realtors of conspiring with real estate brokers to artificially inflate commissions paid when homes are sold.

A federal jury in Kansas City, Missouri, issued a ruling in October favoring the plaintiff. On March 15, the Realtors agreed to a settlement that’s expected to force major changes in how homes are sold in the United States.

Denison’s motion in the Ya Mon Expeditions case requests dismissal of the claims against only Denison, asserting that the company “has done nothing wrong and is being sued for merely being a yacht brokerage and having had an executive that served on the board of” the International Yacht Brokers Association.

Denison states that it has been “lumped into these broad-stroke allegations” that it has “implemented,” “adopted” and “enforced” a rule requiring inflated commissions of 5% each for the seller’s and buyer’s brokers.

The lawsuits refer to the alleged commission requirement as the “Buyer’s Broker Commission Rule.”

But Denison’s motion states that the broker “has no such requirement, does not require its brokers to be members of any association” and does not “require use of any MLS, nor mandate brokers pay cooperating brokers (inclusive of buyer’s brokers).”

Denison is “purely free market” and its “only major requirements are that its brokers be legally licensed and impeccably honest,” the motion states.

Further, the motion states that the lawsuit fails to make specific allegations regarding Denison while making “vague and conclusory” charges against all 15 defendants.

The only specific allegation that forms the basis for naming Denison as a co-defendant, the motion states, stems from company president Bob Denison’s membership on the International Yacht Broker Association board of directors, the motion states. That allegation cannot be used to hold Denison Yacht Sales liable, because there is a lack of “evidence of actual knowledge of, and participation in” what the plaintiffs allege is an illegal scheme.

Other shortcomings of the complaint, as identified in the motion, include failure to allege reasonable restraint on trade or an antitrust injury.

Denison is represented by Beverly Hills, California-based attorney Christopher Brainard, and Emily Heim of Bayramoglu Law Office LLC of Henderson, Nevada. Heim did not respond to an email on Monday and Brainard said he had no comment on Denison’s motion or the cases against the yacht broker industry.

Denison’s response is likely just the first of a cascade of court filings to follow in what has so far amounted to three separate antitrust complaints against the yacht broker industry.

Late last week, attorneys came forward representing defendants Boats Group LLC, Permira Advisers LLC, United Yacht Sales LLC, HMY Yacht Sales, Galati Yacht Sales LLC, MarineMax Inc., and Northrop & Johnson Yacht Ships LLC.

And on Thursday, two of the law firms representing Ya Mon Expeditions and Kip Lamar Snell filed a request to consolidate all three “nearly identical” lawsuits into a single class action lawsuit and appoint as interim co-lead counsel Robbins Geller Rudman & Dowd LLP, an antitrust firm with offices in 10 cities, and Miami-based Podhurst Orseck P.A., a nationally known firm that specializes in complex commercial and class action claims.

Consolidation, the request said, “will result in a more efficient process for this court.”

A Remote Escape in Newfoundland

When Cailey Heaps wants to get away from it all, one place comes to mind: the island of Newfoundland in Canada.

Although she spends most of the year in Toronto, where she runs the real estate brokerage Heaps Estrin and raises her three children — 17-year-old Mimi and 13-year-old twins Declan and Pippa — the craggy, saltwater-sprayed eastern coast of Newfoundland has long held special appeal.

“It’s this very romantic, peaceful part of the world where it feels like time moves at a different pace,” said Ms. Heaps, 47. “I can go there for three days and feel like I’ve taken a two-week holiday.”

In 2021, she was considering buying a country house within an easy drive of Toronto, but the siren song of Newfoundland beckoned. Diving into the listings, she was surprised to find one with a pair of the most quintessential Newfoundland saltbox houses she’d ever seen.

The two white houses, built in 1912 and 1914, were on a property in Salvage, a tiny coastal town with a population of 108, along with three red sheds, a small cemetery and an outhouse at the end of a dock with a hole directly above the water. The parcel was across the harbor from the center of town, on Burden’s Point, but highly visible, and it had been on the market for years. It had even been the subject of news stories focused on worries that the houses might be torn down.

Stuck in Toronto, Ms. Heaps asked her friend and Newfoundland real estate agent Chris O’Dea what he thought of it. “Chris said, ‘Cailey, this is a big project. It’s not what you’re picturing. It’s a massive undertaking. There’s no road access. It’s boat and foot access only,’” Ms. Heaps said. “But I thought to myself, ‘Oh, how bad can it be?’”

She decided to buy it without seeing it in person after a local contractor told her that the buildings could likely be restored for about 250,000 Canadian dollars ($184,000). She closed in March 2022 for 235,000 Canadian dollars ($173,000). Then she asked Reflect Architecture , a Toronto-based studio run by Trevor Wallace, to breathe new life into the structures.

“We went out there to check them out,” Mr. Wallace said. “And, just like with anything that old, there were a lot of surprises.”

Upstairs, the ceilings were about six feet high, so he couldn’t even stand up. Much of the wooden clapboard siding was so soft you could poke a finger through it. The sheds looked ready to topple over.

“Everything was very rickety,” he said. “They had just had a hundred years of good old Newfoundland battering.”

Back in Toronto, Mr. Wallace began drawing up plans to update the two houses and make them comfortable for a new generation, while retaining as much character as possible. The plan was to use the larger, 1,060-square-foot house, which had no electricity or plumbing, as the main living space and Ms. Heaps’s primary suite. The 915-square-foot house — which had a few modern touches, like electricity and a flushing toilet — would become sleeping quarters for her children and a media room.

The architects took pains to preserve the buildings’ exterior appearance: They added new white clapboard siding that mimics the original siding and standing-seam metal roofs. They maintained the original window openings but, inspired by the Canadian painter Christopher Pratt , added new energy-efficient window units with deep jambs to create more striking shadows on sunny days. They added a new window to Ms. Heaps’s bedroom that looks out toward the water and isn’t visible from town, and designed wraparound decks.

Inside, the upstairs ceilings were pushed into the attics for more headroom, and layers of wallpaper were peeled away to reveal the original wood paneling. And new rough-hewed wood was installed in areas where the original paneling turned out to be oddly shaped scraps of leftover lumber.

To give the houses a simple, stylish look while keeping costs down, they got creative with paint. Most of the interiors are painted white, but various saturated colors — muddy gray, forest green, royal blue, peachy pink — define the staircases and bedrooms. The streamlined kitchen has birch plywood cabinets and counters made of butcher block.

Outside, they restored one of the sheds to serve as a future artist’s studio and dismantled the other two, along with the outhouse. Because there is still no road, all of the building materials had to be brought in and out by boat.

Even with such basic material choices and compromises, the construction cost more that Ms. Heaps expected. By the time the work was complete in May 2023, it had ballooned to about 1 million Canadian dollars ($735,000) — quadruple the initial estimate. But it’s money well spent to Ms. Heaps, who is recouping some of her investment by renting out the property on Airbnb when she isn’t using it.

“It’s the most unique setting I’ve ever seen,” she said. “You go out the back door, up the hill and come to a lookout where all you see is ocean, trees and whales. It’s a magical place.”
