Benetti unveils the first B.Now 50M and opens a new chapter in the history of steel megayachts. This 50-metre vessel is one of four B.NOW models with a length of 50, 58, 66 and 72 meters superbly designed by RWD to meet the needs of the most forward-looking owners. The B.NOWs stand out for their construction times reduced by around 30% thanks to Benetti’s advanced construction technology and share a sinuous hull whose profile dynamically marries the interior and exterior decks with large elongated windows. All four models can be built with the Oasis Deck, a design solution enabling the outdoor space to be experienced as an oasis of conviviality and relaxation.

“Iryna”, the first B.Now 50M, offers exclusive access to the water with a 36-square-metre beach club and an infinity pool that seems to be an extension of the stern deck. Nearly half the livable surface area is outdoors, while the fully customizable interiors embody all Benetti’s traditional craftsmanship and quality, as well as being enriched by sophisticated detailing in palladium, one of the most precious metals in the world.

Benetti has laid down another milestone in its long record of innovation in high-end yacht building and presents the first model in the B.Now category, comprising four models with lengths of 50, 58, 66 and 72 metres. This has revitalised the megayacht sector by offering comprehensive personalisation of the layout with casual and contemporary moods that ensure both comfort and privacy. The impressively sleek and sporty exterior styling is by UK firm RWD, which shares with Benetti a mission to challenge classic yacht design and create new boundaries. The British team worked in synergy with the yard to create a steel megayacht category that meets the needs of today’s owners and guarantees delivery times around 30% shorter than the market average thanks to Benetti’s advanced construction technology. The sinuous hull of the four models reflects the dynamic profile formed by the interior and exterior decks with the elongated windows.

With their full-height windows and wellbeing areas, the B.NOWs showcase their modernity to striking effect. The design philosophy puts the owner’s needs centre stage and with the Oasis Deck solution addresses the outdoor spaces in particular. Oasis Deck builds on the extraordinary success of the Oasis 40M by offering wings that open out to increase the available space close to the water but sheltered from the waves; a built-in pool in the beach area; a 270-degree field of view astern and from the saloon; a mix of sunlight and shade that enables guests to enjoy the deck at all times of day; and the Social Design of the entire deck as a spacious and convivial Oasis.

Benetti M/Y “Iryna” “Iryna”, the first B.Now 50M, built for a Ukrainian owner – loyal customer of the Azimut|Benetti Group – is characterised by large glass doors that create a strong sense of continuity between the outdoor and indoor spaces. Like all the megayachts created by the Benetti “House of Yachting”, capable of delivering construction quality on a par with more famous northern European yards, this B.Now 50M establishes a strong connection with the outdoor environment, featuring not only an infinity pool enticingly close to the waves with freshwater and special lighting, but also a 36-square-metre beach club with a gull-wing hatch starboard and a steam room.

“Iryna”, like the other models in the category, is therefore ideal for long cruises. The interiors are the result of collaboration between Benetti’s Interior Style Department and Visionnaire, the interior designer chosen by the owner and an emblem of ‘Made in Italy’ style. Like Benetti itself, Visionnaire produces projects tailored to its clients’ desires and here has created a modern ambience with unique furnishings. The claddings and ceiling panels are made with the finest woods, such as silk-coloured satin-finish frisé maple contrasting with oak. An ivory-coloured leather was chosen for the ceiling and palladium, a precious metal in the platinum group, is used in manually applied, leaf-shaped satin-finish details.

Key features of the layout include the gym on the Upper Deck, the roomy relaxation and sunbathing spaces, and the outdoor lunch area on the Main Deck, which also has an indoor saloon with a lounge and dining zone, as well as a gloriously light-filled owners’ suite in the bow with a private balcony.

Total privacy, always a priority in the Benetti range, is guaranteed by scrupulous separation of guest and crew flows, with the latter able to manage the boat without encroaching on the spaces reserved for the former.

The hull was designed by P.L.A.N.A Design in collaboration with the Azimut|Benetti Research & Development department and the top speed is 15 knots.

The external garage forward of the Main Deck can house a 6.25 metre tender, a jet ski, a rescue craft and four seabobs. The yacht has a range of 4,500 nautical miles at 12 knots and make it possible to navigate for weeks without having to put into port for supplies.

BENETTI SHAPES THE FUTURE: THE NEW VERANDA DECK™ AND THE COLLABORATION WITH IGOR LOBANOV AND ESPEN ØINO

The new B.YOND 55M and “Project LIFE” 85M have been revealed. The new concept “Benetti Veranda Deck™” disrupts the traditional limit between interior and exterior on the Main Deck.

benetti elizabeth yacht

During the “Shaping the Future” press conference held yesterday at Hotel Hermitage in Monaco on the occasion of its 150th anniversary, Benetti presented achievements of the last year and illustrated plans for development, revealing new design concepts. Among the highlights are collaborations with the most authoritative architecture and design studios.

“It is a great pleasure for me to announce our new collaborations and projects today. Offering cutting-edge yachts to the market is our mission, hence the need to further expand the brand’s collaborations with the best designers in the world and announce new revolutions in the world of yachting, of which the Veranda Deck is the new standard bearer. It’s a symposium, a triumph of excellence in yachting under the Benetti flag, and I am very proud of it” stated Giovanna Vitelli, Chair of Azimut|Benetti Group. Veranda DECK™

The yachting world was revolutionized by the Oasis Deck®, a totally innovative concept of the stern beach area and, today, Benetti and RWD announce a new milestone, the Veranda Deck, the reinterpretation of the Main Deck lounge. A space that has seen almost no change in the past fifty years and has thus fallen behind, increasingly avoided due to its excessive formality. The new generation of owners love contact with the outdoors, so the new “Veranda Deck” opens the space completely on three sides, creating a continuous environment between the lounge and the stern. Interiors that transform into exteriors and vice versa provide a new place to enjoy boundless views and contact with the surrounding world. This new concept will be proposed for the first time on the Motopanfilo 45M, a steel project with which Benetti rediscovers the origins of the iconic yachts of the Sixties that made yachting history, with memories of rounded sterns and timeless impact. The exteriors are designed by RWD. Lazzarini Pickering Architetti envisioned the Interior Design and Exterior Deck Design of the 45M in continuity with the 37M, building on their meticulous study of the spaces.

PROJECT B.YOND 55M

The B.Yond family grows with the new 55M whose design bears the signature of Igor Lobanov, his first collaboration with Benetti. The B.Yond line was born from the revolutionary vision of Paolo Vitelli and the creative genius of Stefano Righini, who with the first 37M created the Voyager, not a traditional megayacht, nor an extreme explorer, but a new category in steel designed for intrepid owners with a thirst for discovery, who wish to travel around the world without giving up the pleasure of yachting. Volume, reliability, seaworthiness are the traditional values associated with B.Yond. Igor Lobanov endeavored to enhance the “Voyager” spirit of the line with environments designed to offer guests diverse experiences, even during long stays on board. Each of the five decks was designed for a distinct use, always ensuring privacy and intimacy for guests and crew. Furthermore, to provide for more activities, the concept of layout “fluidity” was introduced. Replacing the classic ideal of symmetry with an innovative approach to the positioning of the stairs, new spaces were created inside the yacht. For the exterior design, Lobanov was inspired by the clean lines of the luxury automotive world, focusing on the creation of fluid yet massive, robust and rounded shapes. A game of optical illusions characterizes the side of this 55-meter vessel, creating a highly suggestive visual effect.

PROJECT LIFE 85M

With the signature of Espen Øino on the exteriors and Francois Zuretti on the interiors, Benetti announces Project LIFE, the new 85-meter to enrich its megayacht fleet. With this project, Benetti relies on the large scale expertise of Espen Øino, one of the most famous names in yachting internationally. With Project LIFE, Øino starts from Benetti’s distinctive characteristic, the capacity to invent new lifestyles, especially on the stern, offering varied interpretations of this concept across the decks. All the spaces aboard Project LIFE are designed for a new kind of social entertainment with large convivial areas and reconfigurable meeting places on each deck. The outstanding example is the large revolving lounge that changes its focal point according to the time of the day. Project LIFE is equipped with all the modern technologies available to reduce consumption: a highly efficient and optimized hull; diesel-electric propulsion with fossil and non fossil fuel (HVO) technology and POD transmission; and integrated hybrid solar panels that collect both solar and thermal energy to power the tenders, toys and appliances.

Over the years, Francois Zuretti has written fascinating pages in the history of yachting together with Benetti, such as Ambrosia, Saga and the Benetti Classic, Tradition and Vision series, to name a few. For the interiors, Francois Zuretti’s decor choices create a perfect balance between the colors and the surrounding environment, which materializes with an expanded opening, allowing natural light to enhance the spaces and the continuously moving landscape. Zuretti worked on the materials and ceiling heights in particular to achieve spatial and stylistic continuity between interior and exterior, creating contemporary and welcoming environments. This modern choice which favors curved lines is perceived in the Main Reception, in the Main Saloon and in the Upper Lounge. Zuretti has enhanced the sea views with floor-to-ceiling windows and designed a lighting system to create evocative atmospheres in all the leisure areas.

PROJECT ORO 85M: THE INTERIORS

During the press conference, Valentina Zannier presented the interiors of “ORO”, her first collaboration with Benetti, whose external design and layout bear the signature of Giorgio Cassetta. ORO’s exterior style is all about sophisticated purity. Soft and uninterrupted lines define a personality through subtle but carefully studied three-dimensional movements. Stately proportions and sheer volume give her an imposing yet graceful presence. The work of Valentina Zannier focuses on the interaction between the contemporary style of the surfaces and the classic details of the yacht, giving the impression of a precious jewel. Fluid shapes and the strong link between external and internal spaces are inevitably connected, while the extensive use of natural materials combined with a palette of neutral yet warm colors endows an authentic air, reflective of a refined development of pure, ancestral shapes and motifs.

THE GREEN ROUTE: making a difference today

Benetti reconfirms its concrete and responsible approach to reducing emissions, a strategy launched over two decades ago and based on the development and implementation of the best technologies available to make an immediate difference. Today, Benetti offers hybrid or diesel-electric propulsion across nearly its entire range, paired with high-efficiency hulls that significantly reduce consumption and CO2 emissions. From the insight that yachts are used at anchor 90% of the time, Benetti also announces a program of solutions aimed at optimizing energy consumption through an innovative Power Management system: for example, the latest generation air conditioning systems allow a reduction in electricity consumption of up to 60%, while the advanced heat recovery system reduces the energy required to heat the fresh water for onboard services. With the progressive decarbonization of the sector in mind and alternative solutions to fossil fuels playing a major role, Azimut|Benetti Group has recently signed an agreement with Eni Sustainable Mobility for the supply of HVOlution, the HVO biofuel produced with 100% renewable raw materials*. The test program conducted in the summer of 2023 demonstrated the full technical efficiency of the biofuel and recorded a well-to-wake reduction in CO2 emissions of more than 80% compared to a yacht of similar size powered by fossil fuel. HVO biofuel is the most mature solution at the moment, ready for immediate and practical use to lower CO2 emissions starting today.

The Benetti Shipyard

The Benetti shipyard has well over a century of experience in creating and delivering the most iconic, innovative, and lavish luxury yachts anywhere in the world. Founded in 1873 by Lorenzo Benetti, the Italian builder continually produces incredible yachts for the most discerning buyers including celebrities, politicians, and royalty. After merging with Azimut Yachts to form the Azimut-Benetti Group, the superyacht builder is now considered the largest production shipyard in the world. In fact, Benetti has appeared at the top of the Global Order Book for superyachts over 20 times. Known for creating the modern superyacht after switching from wood to steel in the 1960’s, Benetti Yachts are now constructed at six different production facilities spread across Italy.

Several incredible production feats have been achieved by the factory, including recently launching 3 giga yachts withing a 100 day period. Owners come to Benetti to realize their dreams and the designers here have the capabilities to make them a reality. Production models begin at approximately 110’ with the Ocean 34M and range to 220’ with the B. Now 68M. The highly customized Benetti Giga Yacht range has also substantially grown and includes several 2019 builds that are well over 100 meters.

The Benetti 40M Oasis recently won for its class at the World Superyacht Awards.

What Truly Sets Benetti Apart

What truly sets Benetti apart from its competition is their fierce commitment to perfectly matching the finest materials in the world, whether for construction or aesthetics, with the vastly skilled craftsmen that have been building luxury yachts for generations. There simply is no substitute for experience when constructing these incomparable vessels. The Benetti designers pride themselves on creating individual solutions for each owner’s wishes so their yachting experience remains exclusive and versatile.

The Benetti Design Hub was established to deliver a unique experience for owners when constructing their own luxury yacht. This collection of experts in the different sectors of fashion design, yacht design, architecture, and art enthusiasts collaborate together with different perspectives and ideas to truly create a unique vessel that is personally tailored to the owner’s tastes.

The interior of the Benetti 37M Motopanfilo is elegant, bright, and inviting for all of your important guests on board.

Propulsion System

Along with being at the forefront of trend-setting yacht design, Benetti is also a pioneer in creating sustainable production processes and models that are as eco-friendly as possible.

Their new hybrid propulsion system, which was conceived exclusively for the FB272 Giga yacht, employs a responsible energy approach as it drastically decreases fuel consumption over the life of the yacht. This particular propulsion package included diesel-electric engines with two Azipods propulsion units powered by a battery pack. The Azipod units are even able to rotate 360-degrees and achieve better fuel efficiency than conventional propulsion systems.

Benetti’s New Oasis Deck

Benetti’s new Oasis Deck is a fascinating design trend born at the Italian shipyard and has made an immediate impact in the expectations of today’s yacht buyer. The Oasis Deck, as seen on the 34M and 40M, completely redefines how the stern is utilized. This luxury resort-style, open-air lounge is just steps from the ocean and creates a beach-area with options for suntanning, swimming, dining al fresco, and enjoying the environment in opulence. While the fold-out bulwarks increase the usable square footage on the Oasis Deck, the submersible bathing platform further integrates the sea into your experience. Enjoying your time on the water in a chic and glamorous environment, with only the horizon in view, is truly what owning a Benetti Yacht is all about. And with the new B.E.S.T. system (Benetti’s Exclusive Sea Technology), all of the on-board electrical systems are easily and conveniently managed by you or the captain.

The Oasis Deck on the Benetti 40M is distinctive and refined, creating a perfect balance of luxury and excitement at the ocean’s edge.

Billionaires are getting ready for summer with wildly spectacular superyachts

  • Superyachts, the most expensive asset  a billionaire can own, are pushing the boundaries of luxury.
  • The boats, which cost eight or nine figures, are getting larger and include more features than ever.
  • From massage rooms to basketball courts, here's what the world's richest want on board.

Insider Today

For many wealthy boat owners, a private spa is a must-have on board. A sauna is a nice touch. A Jet Ski or two makes days at sea way more fun. And if you don't have someone on board who can whip up a Michelin-star-worthy meal , you might as well stay on land.

In the world of massive yachts , there's no such thing as too much. After all, if someone spends eight or nine figures to design the vessel of their dreams — or at least $500,000 a week to charter one — more is more.

"Yachting. It's not rational; it's emotional," Ralph Dazert, the head of intelligence at SuperYacht Times, told Business Insider at the Palm Beach International Boat Show, where dozens of superyachts — often defined as vessels over 30 meters in length — were on display.

And while there are certain classic features, such as jacuzzis and bars, what superyacht owners want is evolving, insiders at the show said. That might mean more crew members, more space for helicopters, or more water toys, but might also include manicure salons and putting greens.

"The bar of what is the baseline expectation has increased exponentially just over the last four or five years," Anders Kurtén, the CEO of brokerage Fraser Yachts, said. Clients are "spending more time on the boat and really wanting to extend the lifestyle they lead on the shore."

A lot of this can be chalked up to the pandemic. Superyacht purchases and charters spiked as life and luxury travel on land screeched to a halt. While the market has moderated slightly, the number of superyachts on order — 1,166 as of September, according to Boat International's Global Order Book — is still above pre-pandemic norms.

"What the pandemic really showed is that the appetite for being out there at sea, sort of living the marine lifestyle, is still as valid as ever," Kurtén said.

That means there's a lot of money on the water. The total value of the 203 superyachts over 30 meters delivered last year was $6.4 billion, according to data from SuperYacht Times. New custom builds from the world's most prestigious shipyards — Lurssen, Feadship, Oceanco , Benetti — can run into the hundreds of millions. Even used superyachts at the Palm Beach show cost as much as $75 million.

And it's not just traditional buyers like retired wealthy couples looking for a place to relax or celebrities looking for a place to party away from the paparazzi. New clients are often younger and have families, so want areas to work and watch movies . They also want pricey water toys, access to fitness equipment, or even pizza ovens for picky eaters.

"This would've never happened in the nineties," said Giovanna Vitelli, the vice president of the Azimut Benetti Group, the world's biggest producer of superyachts. "You would go with your beautiful woman, Champagne — the idea of yachting was much more showing off with your jacuzzi and things like that."

Pure opulence has made room for function.

When Benetti's Nabila set sail in 1980, its 50-person crew, gold-and-diamond-encrusted interiors, and lavish parties captured headlines and even inspired the Queen song "Kashoggi's Ship."(Seven years later, Donald Trump bought Nabila for $30 million , renaming her the Trump Princess.)

"Life on board was considered very formal — big formal dining rooms, boats were high on the water, you would be segregated from the rest of the world," Vitelli said, remembering another client who insisted on a replica of the Sistine Chapel above the dining table.

But the ostentatious, palatial-like interiors that used to be highlighted in yacht brochures have made way for lists of more functional features .

Related stories

Rather than esoteric novelties like an extra-large safe for rifles that one builder had to construct per a Russian yacht owner's request , the superyachts on display at the Palm Beach show featured basketball courts, saunas, and ice baths.

Owners want elevators and luxury gyms. Pampering options, be it a massage room, manicure station, or a professional-grade facial machine, are a dime a dozen. Some bathrooms have fancy Toto toilets, which can cost around $20,000.

Sterns (that's the back of the boat) used to be built high to guard guests' privacy. Now, they're built as "beach clubs" — an open swim platform.

And what good is a massage room if no one on board can give one? Many superyachts can hold twice as many crew members as guests, if not more. One broker, representing a boat that didn't have a masseuse, said it could be quite a "tricky" issue because if a charter wants one, they have to find someone who can massage guests and "pull their weight with the crew."

"It's not uncommon to look for a deckhand who can also mix a martini, play an instrument, maybe entertain the guests with singing, and ideally even give a massage," Kurtén said.

Of course, a crew comes at a cost . Most are considered full-time employees, requiring salaries and benefits like health insurance. Captains, first mates, and chief engineers often make six figures a year. That's without tips; a charter guest will typically spend six figures on gratuities for the crew who worked during a weeklong vacation.

For the superrich, there must be room for toys.

It's not just the onboard amenities that count. What's known as "toys" in the industry — water slides, eFoils, Jet Skis, and underwater scuba diving jets — are popular, and costs range from merely hundreds of dollars (banana boats) to millions ( submersibles , which are still popular despite the recent tragedy).

" Tenders and toys, the sky seems to be the limit," Kurtén said. "More is more."

Of course, if you can't fit all those toys in the yacht's storage space, you can just use another boat. Jeff Bezos' support yacht is a superyacht in itself, measuring 75 meters and costing tens of millions of dollars. (His main yacht, Koru , cost a reported $500 million.)

Support yachts are also faster, meaning the crew can get to a destination first and set up the Jet Skis, seapools, and the like, Dazert said. "By the time the owner arrives on the main yacht, everything's set up, and he can go and have fun."

Even tenders, the smaller vessel that brings guests from the ship to the shore, are getting glow-ups. The Nero, a 90-meter beauty available to charter for about $500,000 a week and modeled after J.P. Morgan's 1930s ship, has custom-built tenders to match the design. The most expensive ones often cost seven figures. Nero has three.

"It used to be a tender was a tender," Jeffrey Beneville, who handles yacht insurance at NFP, told BI. "Now they're called limousine tenders. Think of an incredibly luxurious gondola that's got a hard top so nobody's hair gets mussed when they're being dropped off at the Monaco Yacht Club ."

One thing that clearly hasn't changed in superyachting: showing off. If the boat next door at the marina has an indoor-outdoor cinema, it's natural to want one too. Ditto a wine cellar or helipad.

"It's a bit of a celebration of your success in life, of wealth," Vitelli, whose company is behind the Lana yacht Bill Gates chartered for a birthday party three years ago, said. "You push it a little more."

And that's a boon for yacht makers and brokers catering to the superrich.

"Our job is to make clients' dreams come true," Kurtén said.

Business | south florida yacht brokers hit with lawsuits that claim 10% commissions violate antitrust laws.

Yachts are among the vessels seen on display in this 2019 file photo in Palm Beach County. Two new lawsuits, filed in 2024, aim to upend years-old ways of awarding commissions to brokers representing boat sellers and buyers. (South Florida Sun Sentinel file photo)

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Geller is a partner at Robbins Geller Rudman & Dowd LLP, which specializes in securities litigation on behalf of investors. The firm has offices in 10 cities, including Boca Raton.
