About Yacht-Pool

The yacht-pool story.

Dr. Schöchl initially wanted nothing to do with insurance. However, he was greatly annoyed by the poor conditions at the expense of the customers of the family business Sunbeam Yachts, which is why he wrote the YACHT-POOL hull and liability conditions, thus becoming the initiator of all-risk coverage . A fundamental innovation in boat and yacht insurance. They far surpassed traditional individual risk coverage in terms of customer orientation!

Since insurance conditions could not be patented, they were gradually copied by competitors over the years and are now in the market. At YACHT-POOL, policyholders were grouped into a “POOL” – hence the name YACHT-POOL, which was intended to speak with one voice and provide a counterweight to insurance companies and their teams of lawyers, to which the individual was always inferior.

In the charter sector, Dr. Schöchl was the first to recognize the high personal liability risk of the charter skipper, which he considered unacceptable. He formulated and wrote the corresponding skipper liability conditions, thus launching the protection of charter skippers. He is therefore considered one of the inventors of Skipper Liability Insurance.

But it didn’t stop there. Further specialized insurances such as charter deposit insurance, charter cancellation insurance, and a range of other coverage concepts were developed. In professional circles, YACHT-POOL thus became a pioneer in charter insurance and trendsetter for water sports insurance.

Moreover, YACHT-POOL evolved into a kind of “ombudsman” for questions that went beyond insurance solutions. This includes the quality seal “CHECKED & TRUSTED Financial Security,” which provides charterers with better guidance in choosing economically stable charter agencies and fleet operators, thereby minimizing the risk of insolvency.

Equally important was the development of the “FairCharter Contract” – a standard contract of terms and conditions for charterers designed to protect the charter skipper from problematic “voluntary liability agreements” where no insurance coverage applies.

The international associations EBI (European Boating Industry) in Brussels and ICOMIA (International Council of Marine Industry Associations) in London adopted this contract as a model for international and official general charter standard conditions.

Report from the trade magazine Boote 1.2024 – The clear conditions of YACHT-POOL’s charter fair contract convince the leisure boating lobby! Unclear conditions and toxic clauses in charter contracts could soon be a thing of the past, or at least the exception. The European and global associations of the leisure boating industry, EBI (European Boating Industry) in Brussels and ICOMIA (International Council of Marine Industry Associations) in London, recognized the importance of this topic for nautical tourism, a conflict-free charter business and, last but not least, for the reputation of the entire industry.

Several meetings were held with the presidents of the national associations of charter companies and charter agencies to find the best possible general terms and conditions. The choice fell clearly on Yacht-Pool’s Charter-Fairvertrag, which was already available in all relevant languages and represented a fair balance of interests between charter companies and charterers.

The online platform “myrentboat.com” has not forwarded customer payments and is now leaving skippers out in the cold. A textbook example of what you should bear in mind when chartering online.

With new seals of approval, the insurance broker wants to provide guidance and contribute to loss prevention.

As the charter season draws to a close, our wealth of experience (and that of many a charter skipper) has once again been enriched by many a bizarre incident. Most of the charter trips went smoothly over the water, some were particularly “adventurous”.

Following the “Checked & Trusted” seal of approval for charter companies, the insurer Yacht-Pool is now making people sit up and take notice with two more labels: A seal for skippers and one for marinas are in the works.

Yacht-Pool: More Than Insurance

Logical concept, commitment and the positive experience of its customers have made Yacht-Pool one of the leading yacht and skipper insurers

Yacht-Pool was founded in 1976 by Dr. Friedrich Schöchl, who still leads the company. The founding impetus and sustainable motor of the growth of the company was the insufficient knowledge at that time on the subjects of maritime law and legal risks for skippers and yacht owners. As an active sailor and through family ties, Dr. Friedrich Schöchl found that many of the superyacht insurance policies common at that time had significant coverage gaps and legal uncertainties to the disadvantage of sailors.

In 1976 he founded Yacht-Pool as ‘Pool of Yacht owners and Skippers’ to counterbalance the asymmetrical relationship between the always alone standing owners and skippers and the always strong insurance companies. With its total volume, Yacht-Pool has become a serious partner for insurers. This enabled company to develop and implement their own insurance conditions, carefully made for the needs and interests of the customers.

Instead of looking for customers for insurances, company focused from the beginning on the needs of customers and developed suitable coverage concepts, for which insurers were then found who were willing and able to bear these new risks.

A major achievement was the introduction of ‘All-Risk Coverage’ (everything that is not excluded is insured), which was far superior to the usual ‘single-risk-coverage’ (insured is only what is explicitly stipulated) in every respect. Another outstanding invention of Yacht-Pool is the Skipper-Liability-Insurance, which today has become a matter of course for almost every skipper. All other charter insurance that is common today also origins from the Yacht-Pool think tank.

To date, company develops all its insurance and service products without exception itself – from practice for practice. Everything from product development and policy to claims management is under the control of company and this practice-oriented service concept is the reason why Yacht-Pool is nowadays one of the major European insurers for charter skippers, owners and charter fleet operators and is represented in many countries from Finland to Greece with its own branches and selected surveyors and experts. From early 2018, Yacht-Pool has been operative in Croatia as well, as a franchise holder led by the founder and owner Dr. Friedrich Schöchl.

Our company has a fleet of 6 sailing yachts, varying in size from 10 metres to 15 metres. Offering to all our existing and future clients the enjoyment of a relaxing and fun filled sailing experience. Ideally situated in puerto Pollensa with its excellent weather conditions and surrounded by the beautiful mountain range. We have locally excellent services and facilities. Well stocked supermarkets to ensure you have all you will need for preparing for your journey be it round this lovely island or further afield. You will also receive assistance to and from the supermarket, we provide showers and the “Cantina Restaurant Moll”, which are right on your doorstep. Mooring assistance from the always helpful and friendly marineros of the port.

Charter-Kautionsversicherung

Unwetter – volle Häfen – überlaufene Buchten. Die Schäden an Charterschiffen werden immer häufiger – die hinterlegte Kaution ist weg!

Die Lösung: eine Charter-Kautionsversicherung von YACHT-POOL!

Jeder erfahrene Skipper weiß, wie schnell die Harmonie der Crew empfindlich gestört ist, wenn von ihm oder einem Crewmitglied ein Schaden verursacht wurde und alle zur Kasse gebeten werden sollen. So einig sich die Crew vor Antritt der Charter auch war, so uneinig ist man sich schnell, wenn alle für den Schaden zahlen sollen, den nur Einer verursacht hat. Das ist meist der Skipper selbst – aus seiner Verantwortung als Schiffsführer.

Entlasten Sie als verantwortungsbewusster Skipper Ihre Crew und sich von diesen Sorgen und genießen Sie einen unbeschwerten Törn!

Selbstverständlich führte dies dazu, dass verantwortungsbewusste Skipper immer klarer eine Versicherung dieses persönlichen Risikos forderten. Die Kautionsversicherung von YACHT-POOL gilt nicht nur für eine bestimmte Charterwoche, sondern gilt unbeschränkt für ein ganzes Jahr – weltweit!

Weil Sie damit chartern können, wo Sie wollen, sooft Sie wollen, welches Schiff Sie wollen und solange Sie wollen – weltweit!

Gemäß den YACHT-POOL Bedingungen für die Kautions-Versicherung werden berechtigte Einbehalte der Kaution von uns erstattet, wenn sie vom Skipper und/oder der Crew verursacht wurden, und zwar bis zur Höhe der gewählten Versicherungssumme, die i. d. R. der Höhe des Selbstbehalts der Kasko-Versicherung entspricht. Liegt die Höhe des Schadens über dem Selbstbehalt, hat dies die Kasko des Eigners zu bezahlen. Die einbehaltene Kaution sollte deshalb in der Regel den Selbstbehalt der Kasko-Versicherung nicht übersteigen. Bitte achten Sie darauf, dass nur berechtigte Einbehalte von Ihrer Kaution abgezogen werden!

Ungerechtfertigte Einbehalte treffen auf Schäden zu, die nicht durch schuldhaftes Handeln des Skippers oder seiner Crew verursacht wurden, sondern z.B. auf mangelhafte Konstruktion oder Materialermüdung zurückzuführen sind, wie Reißen der Vorstag ohne äußere Einwirkung, Reißen von Wanten oder der Ankerkette etc.. Bitte klären Sie in solchen Fällen mit dem Vercharterer, warum Sie für Schäden haften sollen, für die Sie keine Schuld trifft, und teilen Sie uns ggf. die Begründung mit.

Verhalten Sie sich so, als wären Sie nicht versichert und handeln Sie nicht leichtfertig. Dazu sind Sie gemäß Versicherungsvertragsgesetz verpflichtet. Das Versicherungsverhältnis ist eine interne Rechtsbeziehung zwischen Ihnen und dem Versicherer. Argumentieren Sie damit nicht bei der Charterbasis, denn es könnte missverstanden werden und Ihren berechtigten Verhandlungsstandpunkt erschweren „….weil Sie ja eh versichert sind“. Bei nachhaltigen „Missverständnissen“ könnte dies langfristig zum Ausschluss bestimmter Charterfirmen von der Versicherungsdeckung führen. Werden Schadenforderungen, die Sie nicht abwehren können, von Ihrer Kaution einbehalten, so lassen sie sich darüber vom Vercharterer eine Quittung und ggf. eine entsprechende Reparaturrechnung geben und senden Sie diese Quittung mit einem Schadenbericht, der von allen Crewmitgliedern unterzeichnet ist, unmittelbar nach Ihrer Ankunft zu Hause, ein. Empfangsberechtigter der Versicherungsleistung ist der in der Police genannte Versicherungsnehmer.

Achten Sie darauf, dass Ihre Kaution nur für Schäden an der gecharterten Yacht (so soll es in dem Chartervertrag stehen!) und nicht für Haftpflichtschäden greift. Dafür haftet primär die Haftpflicht- Versicherung der gecharterten Yacht und subsidiär ggf. die Skipper-Haftpflicht-Versicherung. Bei Vertragsabschluss sollten Sie beachten und ggf. schriftlich klären:

• d ass die hinterlegte Kaution ausschließlich für Sachschäden einbehalten wird, die Sie oder Ihre Crew am Schiff verursacht haben und dass Schäden ggf. durch Reparaturbelege nachzuweisen sind,
• dass es für Haftpflicht-Schäden in der Regel keine Selbstbeteiligung gibt und daher die Kaution auch für Haftpflichtschäden nicht zur Verfügung steht.

Prüfen Sie, ob dies in Ihrem Chartervertrag eindeutig geklärt ist. Wenn Zweifel bestehen, machen Sie eine klärende Zusatzvereinbarung zu o.a. Punkten. Damit verhindern Sie evtl. spätere rechtliche Auseinandersetzungen. Dies ist für Sie wichtig. Denn es kommt immer wieder vor, dass Kautionen nach beliebigem Ermessen einbehalten werden. Und das ist dann ein rein vertragsrechtliches Problem

Viele Vercharterer bieten eigene „Charter-Kautionsversicherungen“ an. Diese sind aber oft keine echte Versicherung , sondern eine Eigenkalkulation. Es gibt k eine verlässlichen Bedingungen und die Ausschlüsse – z.B. Grundberührung, Schäden am Ruder, dem Dinghi, Kratz- und Schrammschäden oder dem Außenbordmotor – widersprechen oft einem realistischen Versicherungsschutz.

Unterschied von Haftpflicht- und Kautionsversicherung:

Ein Charter-Kautionsschaden ist i. d. R. ein Schaden am gecharterten Schiff, der vom Skipper oder Crew schuldhaft verursacht wurde und der in der Regel unter der Höhe des Selbstbehalts der KaskoVersicherung liegt.

Diese Schäden deckt die Kautions-Versicherung! Liegt die Höhe des Schadens über dem Selbstbehalt, zahlt die Kasko-Versicherung des Eigners..

Die Haftpflicht-Versicherung des Yachteigners greift für Sach- und Personenschäden, die Sie anderen schuldhaft zufügen. Was aber tatsächlich gedeckt ist und was nicht steht in den Haftpflichtbedingungen des Eigners, die Sie nicht kennen. Keine uns bekannte Haftpflicht-Versicherung deckt Schäden am gecharterten Schiff. Kaskoversicherer greifen für grobe fahrlässige Schäden am Schiff auf den Skipper zurück.

Die Skipper-Haftpflicht-Versicherung deckt die (unbekannten) Lücken, die die Haftpflicht-Versicherung der Charteryacht aufweisen kann, z. B.:

• Schäden an der Yacht aufgrund grober Fahrlässigkeit (schützt Sie vor der Haftung gegenüber dem Kasko-Versicherer).
• Personenschäden an Crewmitgliedern
• Schäden an anderen Schiffen, soweit diese Schäden nicht durch die Haftpflicht der Charteryacht gedeckt sind, z. B.: weil die Prämie nicht rechtzeitig bezahlt wurde oder sonstige Ausschlüsse der Haftpflicht-Versicherung des Vercharterers Leistungen ausschliessen (die Sie nicht kennen), wie beispielsweise Personenschäden an Crewmitgliedern o. ä.

Her interior is styled by Australian designer design house Sam Sorgiovanni and she was delivered to her owner in April 2012. This luxury vessel's exterior design is the work of Sam Sorgiovanni.

Powered by twin diesel MTU (20V 4000 M73L) 20-cylinder 4,828hp engines running at 2050rpm, she comfortably cruises at 16 knots, reaches a maximum speed of 19 knots with a range of up to 6,800 nautical miles from her 284,970 litre fuel tanks at 14 knots. Nirvana features at-anchor stabilizers providing exceptional comfort levels. Her water tanks store around 79,992 Litres of fresh water. She was built to Lloyds Register ✠100 A1 SSC Yacht (P) MONO G6 ✠ LMC UMS SCM classification society rules, and is MCA Compliant.
