Sanctioned Russian billionaire wins right to use his yacht on the French Riviera

PARIS (Reuters) - A French court on Wednesday ordered the country's customs agency to release an impounded yacht owned by a Russian billionaire hit by European sanctions, due to procedural errors made during the seizure of the vessel.
Customs agents seized the 27-metre "La Petite Ourse" on March 16, after its owner, Alexey Kuzmichev , one of the main shareholders of Russia's Alfa Bank, was sanctioned by the EU in March for his ties to President Vladimir Putin .
The Paris Appeals court ruled that customs officers had not followed correct procedures when they boarded the vessel, which was moored in the Cote d'Azur town of Antibes.
The agents had cited a fraud investigation when they presented themselves to shipyard authorities, which under French law permits customs to search a vessel.
The ruling underlines the challenges faced by European nations in freezing the assets of Russian oligarchs.
Kuzmichev sued the French authorities in an effort to win back access to his two yachts held in France, La Petite Ourse and La Petite Ourse II.
As a sanctioned individual whose assets are frozen, Kuzmichev is still prohibited from taking La Petite Ourse out of French territorial waters, but he is now allowed to access the yacht and use it within French waters, his lawyer said.
"Inside [of France], he is allowed to move around, whether by foot, by horse, by car or by boat," lawyer Philippe Blanchetier said.
The court also ordered that French customs pay the tycoon 10,000 euros in compensation.
The customs agency declined to comment immediately.
A court in Rouen will rule on the second vessel, La Petite Ourse II, moored in Cannes, at a later date.

Antibes : la justice annule la saisie du yacht d'un oligarque russe
Grâce à un vice de procédure, Alexey Kuzmichev va de nouveau pouvoir naviguer à bord de la Petite Ourse, un de ses bateaux amarrés sur la Côte d'Azur. Mais son yacht devra rester cantonné aux eaux territoriales françaises.
Les douanes ont-elles confondu vitesse et précipitation? Le 16 mars 2022, soit à peine 24h après que l'Union européenne a inscrit Alexey Kuzmichev sur la liste des oligarques russes dont il a été décidé de geler les avoirs, 5 agents se présentent au chantier naval du Port Vauban, à Antibes. Ils viennent inspecter u n yacht de 27 mètres, la petite Ourse, propriété du milliardaire russe, d'une valeur de 4 millions d'euros, et décident de sa saisie.
Immédiatement, c'est la justice que l'oligarque décide de saisir. Son avocat, Maitre Philippe Blanchetier, invoque notamment un vice de procédure : pour permettre ce contrôle, les douaniers ont prétexté une recherche de fraude à bord du bateau. Or aucune fraude ne sera évoquée dans les différents procès verbaux dressés après leur visite.
La cour d'appel de Paris a donc annulé cette saisie. Joint par téléphone, Maitre Philippe Blanchetier se dit satisfait par cette décision :
"J’y vois le triomphe du droit sur l’improvisation dictée par d’obscures préoccupations politiques." Maitre Philippe Blanchetier, avocat d'Alexey Kuzmichev
Des préoccupations selon lui obscures, et parfois même incohérentes : l'avocat rappelle que son client a une résidence à Paris, d'où il peut entrer et sortir à sa guise. Idem dans sa somptueuse villa tropézienne. "Entre le Var et Paris, il a le droit d'utiliser des véhicules à moteur (...) Quelle est la différence entre une voiture et un bateau?"
Il conteste même le statut d'oligarque prêté à Alexey Kuzmichev. Pourtant, dans cette fameuse liste noire dressée par l'Union européenne , les griefs sont détaillés :
"Alexey Kuzmichev est un grand actionnaire du conglomérat d'Alfa Group, qui comprend Alfa Bank, l'un des plus grands contribuables de la Russie. Il est considéré comme l'une des personnes les plus influentes de Russie. Ses liens avec le président russe sont bien établis". Journal officiel de l'Union européenne, 15 mars 2022
D'ailleurs, malgré l'annulation de la saisie de son yacht, ses avoirs restent gelés. Et s'il peut de nouveau naviguer à bord de la Petite Ourse, c'est uniquement dans les eaux territoriales françaises
Alexey Kuzmichev a entamé un second recours, pour un autre bateau, la Petite Ourse II, amarré à Cannes et dont la justice décidera du sort prochainement.

French police detain Russian tycoon over alleged financial and sanctions violations
Alfa Bank founder Alexey Kuzmichev was sanctioned by EU for ‘well-established ties’ to Vladimir Putin
Police in France have detained the Russian tycoon Alexey Kuzmichev and raided two of his properties in connection with alleged tax evasion, money laundering and sanctions violations.
The French financial prosecutor’s office said on Tuesday that searches had taken place a day earlier at Kuzmichev’s Paris home and an estate in in the Mediterranean Var region.
Kuzmichev was still detained on Tuesday but had not yet been charged. His lawyer, Philippe Blanchetier, declined to comment when contacted by Reuters.
Kuzmichev, one of the founders of Russia’s Alfa Bank, was sanctioned by the EU shortly after the start of Moscow’s invasion of Ukraine for his “well-established ties to the Russian president”.
According to the EU, Kuzmichev was “actively supporting materially or financially and benefiting from Russian decision-makers responsible for the annexation of Crimea or the destabilisation of Ukraine”.
In the same ruling, the EU also sanctioned Kuzmichev’s Alfa Bank partners Mikhail Fridman, German Khan and Petr Aven.
French customs agents last year seized the billionaire’s 26-metre (86ft) yacht La Petite Ourse, as part of the sanctions, a move that sparked a legal battle between authorities and Kuzmichev.
Forbes magazine lists Kuzmichev, 61, who set up Alfa Bank with his colleagues in 1990, is the 61st richest person in the world, with a total fortune of £5.3bn.
Following sanctions against him, Kuzmichev sold his stakes in the bank last year to Andrei Kosogov, an Alfa Bank shareholder who is not under sanctions.
Kuzmichev is one of the few sanctioned Russian oligarchs who stayed in Europe after the war in Ukraine began.
His business partner Fridman, who is also sanctioned in the UK, flew back to Moscow earlier this month, while Khan returned to Russia last year.
Last week London’s high court declined Fridman’s request to spend thousands of pounds a month on the the upkeep of his London mansion, containing a £44m art collection.
While some oligarchs have backed Vladimir Putin’s invasion, Kuzmichev is one of the few major businesspeople to have spoken out against the war, albeit in guarded terms.
“My mother was Ukrainian, I have a huge number of relatives and friends there,” Kuzmichev told the Russian Forbes website last year, adding that he agreed with Fridman, who said that the conflict was a “tragedy” and that war “can never be the answer”.
The Kremlin said on Tuesday that Russia would be able to defend Kuzmichev’s rights once Paris provided detailed information about his case.
“As far as I understand, he is a citizen of the Russian Federation so we should receive information about the detention through our diplomatic mission,” Putin’s spokesperson, Dmitry Peskov, told reporters.
“Once we receive the information, and if the detainee so wishes, we will of course assist in protecting his rights as a Russian citizen.”

The 31.5m/103'4" motor yacht 'La Grande Ourse' (ex. Falcon 102/136) was built by Falcon in Italy at their Viareggio shipyard. Her interior is styled by design house Falcon and she was completed in 2007. This luxury vessel's exterior design is the work of Falcon.

Range & Performance
Built with a GRP hull and GRP superstructure, with teak decks, she has impressive speed and great efficiency thanks to her planing hull. Powered by twin diesel MTU (16V 2000 M91) 16-cylinder 2,000hp engines, she comfortably cruises at 23 knots, reaches a maximum speed of 27 knots with a range of up to 600 nautical miles from her 10,500 litre fuel tanks. Her water tanks store around 2,500 Litres of fresh water. She was built to RINA (Registro Italiano Navale) classification society rules, and is MCA LY2 Compliant.
